Agreement to Terms
These Terms govern your access to and use of Echo (the "Service") provided by Echo Ltd ("Echo", "we", "us"). By using the Service, you agree to these Terms.
Description of Service
Echo provides tools for scheduled messaging, AI drafting/summarization, and search over user-provided content. Echo is not affiliated with WhatsApp or Meta.
Accounts & Eligibility
- You must provide accurate information and keep it updated.
- You are responsible for maintaining the security of your account and devices.
Your Content & License
You retain ownership of your content. You grant Echo a worldwide, non-exclusive, royalty-free license to host, process, and display it solely to provide and improve the Service.
Acceptable Use
- No unlawful, harmful, infringing, or spam activity.
- Obtain required consents for messaging recipients and comply with privacy laws.
- No reverse engineering, bypassing security, or abusing rate limits.
- No use in life-critical or high-risk scenarios.
Third-Party Dependencies & Delivery
Scheduled Messaging & Retries
At the scheduled time Echo attempts immediate delivery. If delivery fails due to a transient condition (e.g., device offline, network hiccup, temporary provider error), Echo performs a fast automatic retry within a short retry window. If delivery still fails, the message is marked Action Required and you are notified so you can manually send or reschedule.
- Fast retry: a limited burst of automatic retries shortly after the scheduled time.
- Failure notification: in-app alert (and email/WhatsApp if configured) with the failed item highlighted.
- Manual control: Echo does not continue attempting indefinitely; you can resend, edit, or delete.
- Limits: Delivery may still fail due to platform restrictions, device state, or provider outages. See the sections “Third-Party Dependencies & Delivery” and “Limitation of Liability”.
Service Levels
The Service is provided on a best-effort basis and “as is”. Unless a separate signed SLA applies, no uptime or delivery guarantees are offered.
Fees, Billing, Refunds
- Fees are charged per the plan you select. Taxes may apply.
- Except as required by law, payments are non-refundable. Credits may be issued at our discretion.
- Plans may include usage limits or fair-use thresholds.
Refund Guarantee
If you are unsatisfied, you may request a full refund within 14 days of your initial payment. After this period, all fees are non-refundable except as required by law. Credits or goodwill refunds may be issued at our discretion.
Changes
We may modify features. Continued use after changes constitutes acceptance.
Termination
- You may stop using the Service at any time.
- We may suspend or terminate access for breach, risk, or legal compliance.
- Upon termination, we will delete or de-identify your content per our Privacy Policy.
Indemnification
You agree to indemnify and hold harmless Echo and its affiliates from and against any claims, liabilities, damages, losses, and expenses (including legal fees) arising from your use of the Service, your violation of these Terms, or your violation of any applicable laws or third-party rights.
Disclaimers
The Service is provided “AS IS” and “AS AVAILABLE”, without warranties of any kind. We do not warrant delivery times or error-free operation.
Limitation of Liability
Governing Law & Dispute Resolution
These Terms shall be governed by and construed under the laws of Israel, without regard to its conflict of laws principles. Any dispute arising from or relating to the Service shall be exclusively resolved in the competent courts of Tel Aviv, Israel.
Force Majeure
We are not responsible for any failure or delay caused by events beyond our reasonable control, including acts of God, natural disasters, labor disputes, internet or utility failures, governmental actions, or third-party service interruptions (including WhatsApp or API providers).
